Litigation in the Netherlands
The commercial litigation practice of Minerva Advocaten involves types of disputes that can arise in the business context, including breach of contract cases, partnership/joint venture disputes, business torts and shareholder issues. Since 1 January a new form of litigation is introduced in the Netherlands. It is now possible to bring a claim before the Netherlands Commercial Court (NCC). The NCC handles cases in English as standard and makes a judgment in English. Our lawyers are admitted to plea before the NCC. We can also design a clause for your choice of forum that suits your company and that you can include in your contracts and general terms and conditions. We know the advantages and disadvantages of the various procedures and can help you make the right choice for your contracts.
